SAPINDA,
INCEST, Relationship with Cousin
This is NOT allowed
under law as follows:-
INCEST means
relationship with cousin. There has been seen of late that in many cases
INCEST is the root cause of breakdown of many relationships even to such an
extent that the husband feels shy to tell that his wife is in relation with her
own first cousin i.e., brother.
Such relationships
with first cousins (incest) often go unnoticed till it turns out to be an
epidemic because society treats them like brother-sister & even they call
each other often as bhaiyya didi.
As per HINDU LAW this
relation between first cousins is NOT allowed. And marriages between such
spouse is debarred from law under the heading SAPINDA Act & these
relationships are known under the act as SAPINDA RELATIONS. As per the act,
even if many years have passed & even chidren have born from such
relationships then also whenever such relationships comes to the notice of
Hindu Organizations or Law bodies then it shall be treated as void ab-initio
& such spouses are NOT allowed to live together.
Few fighter victims
of false 498a & false DVC on them might even try to file SAPINDA on the
wife’s relatives to be used as a pressure tactics on opposite parties. (because
they knew from their wives any relatives from their family who married first
cousins)

ADULTERY, INFIDELITY, SECTION-497 IPC
Protection of MEN FROM MEN. (And NOT men from women)
Section 497 of the Indian Penal Code is one of two sections which
PROTECTS MEN FROM MEN.
Section 380 protects his goods and chattels,
Section 497 protects his wife from other MEN.
Punishment for adultery is
imprisonment up to five years.
Given that the legal cycle usually takes 10-12 years, it is
likely that by the time one comes out of jail, he will no longer be able to get
it up.
Therefore, men planning to indulge in sexual intercourse outside
of marriage (especially creating relationship with other women) are requested
to consider the following:-
a) It is only adultery if
the said affair occurs without the permission of the husband. Hence, if you
want to avoid a jail sentence, then it’s better to take written consent from
her husband. This makes it legal.
b) It is not adultery if a
married man has affair with an unmarried woman or a widow. In such cases, no
penalty applies so cheers.
c) In case the matter is
urgent, and it becomes essential to have sex with a married woman, try to make
sure that the said sex is non-consensual i.e., without the consent of the lady.
This does not qualify as adultery. At least her husband can not charge you. Of
Course, she can charge you for rape bla bla but NOT adultery.
What can a man do if his
wife has been adulterous with someone else? The law is very clear on this
point. Husband can prosecute the man, or men, as the case may be. However, he
cannot prosecute his wife, even if she does it repeatedly, in his presence, in
front of CCTV cameras, with multiple partners, one by one or simultaneously.
Which brings good news for
women but brings shame for Indian judiciary. Women cannot be prosecuted for adultery in India. So does
that mean a go ahead for women. This is one of the few laws which actually favor
ladies. They might as well try to make the most of it.
CASELAW: Sowmithri
Vishnu Vs. Union of India & Another (1985) – SUPREME COURT
This
section 497 ADULTERY was challenged because in almost all the countries woman
is charged for adultery but in India we believe that a woman can NOT do such
thing. For a woman to get protection she just needs to say that she never
consented. Now the protection for the adulterous man comes only in proving that
this woman consented to have sex with him. A married woman must be held equally
responsible for NOT reporting any non-concensual intercourse & later on if
any other innocent MAN gets in trouble due to her prior consent for sex & later
on hostility when such relationship is trapped in section-497 or related laws so
that EQUALITY prevails in India.
NEED FOR PIL
The above
cited case law was 30 years back but the current scenario has changed so if
anyone with new statistics goes & challenges this section-497 in Supreme
Court then the positive results might be achieved in the field of MEN RIGHTS
ACTIVISM.

Hyd ‘child bride’ racket continues: Foreigners visit city, marry, divorce, leave

‘sold’ their 16-year-old daughter to a 77-year-old Omani national for Rs 5 lakh
"It has not stopped and it won't stop any time soon. It is a systematic problem and not easy to get rid of," Jameela tells TNM.
Or, they come to India on a short-term visa, 'marry', stay with the minor for two or three months in India and then 'divorce' them, Jameela says.

Or, they come to India on a short-term visa, 'marry', stay with the minor for two or three months in India and then 'divorce' them, Jameela says.
ABJECT POVERTY
Explaining the reason why such rackets thrive, Jameela says, “Agents identify families who live in abject poverty.
STEPMOTHER OR STEPFATHER
Most of the times, the person who gives the minor away is usually the stepmother or the stepfather, if not a relative or a neighbour.
Women who are burdens on family
The members of Shaheen say that women, who bear a disproportionate burden in the families, are often treated as subordinates who can be trafficked for sex in exchange for money, with little freedom to make their own choices.
girl's father-mother died
The minor began staying with her maternal grandmother and uncle’s family. When Begum was 13, her aunt discontinued her education and sold her off to a Sudanese national, who was over 50 years old.
female agents scout slums and befriend family
the female agents befriend the family and convince them to marry off their daughter to these sheikhs
Lipstic Bindi Cream etc during Office Time
When the time comes to parade the girls who are up for sale, a large hall is booked and all the sheikhs are seated in the room. The minors are often accompanied by the family, who wait outside, as each girl walks into the room to be sized up by the sheikhs. While the female agents ‘dress up’ the girls for the ‘suitor’, the male agents coordinate with the sheikhs and strike a deal with them.
Minors with at least 50+ year old sheikh
Minors are generally aged between 12 and 16. “In all my years of conducting sting operations, I am yet to see a sheikh aged below 50,” Rehana adds.
Give Rs.1,000 or gold or gadget
If a sheikh likes a girl, he gives her up to Rs 1,000 on the spot or some gold or a gadget like a phone. The minor often does not understand what is happening but they are generally happy at that moment because they are often showered with gifts that their parents would not have been able to afford,” Rehana elucidates.
Cost = Rs.5,000 per month only
If the foreign national plans to stay in Hyderabad for only a month or two, minors are sold off for anywhere between Rs 5,000 and Rs 50,000. If the minor is to be trafficked out of the country, the cost runs into a few lakh.
Parents expect future money from sheikhs
“The agent receives 50% of the amount as commission, while the remaining goes to the family. However, the family also has to spend on the nikah and they often oblige, hoping they would get more money from the sheikh in the future; and the agents prey on such hopes,” Rehana points out.
Minor signs papers as 18 years old [N.O.D.]
“Meanwhile, the agents also arrange for fake documents to show that the minor is above 18. Many times, when the couple sign papers for the nikah, papers for talaq (divorce) too are slyly placed underneath, and the minor signs it without realising it,” Rehana says.
Use and Throw
“This ‘marriage’ lasts anywhere from 15 days to three months, depending on the whims of the sheikh. He sexually abuses the minor on a daily basis after taking up a house or lodge for rent in old city itself. Once the sheikh is 'satisfied', he divorces her and goes back," Rehana adds.
Girls labelled as Promiscuous
In cases where women have been trafficked abroad and married, they are labelled promiscuous and given a divorce within a few months as well, following which they are forced to return to Hyderabad.
Once exploited by the sheikh, the minors are often in dire straits. Left with no choice, they end up marrying another sheikh, as marrying local men would mean that they would have to pay for the dowry.
Many gruesome cases have come to light. We met a minor who had been married to four different sheikhs by the time she was 18 years old. Finally, she married a man who she was in a relationship with, and it worked out.

Adultery Not a Crime Anymore! Expert Explains Attractions Outside Marriage, Cheating and Extramarital Relationships
The Supreme Court junked an archaic 158-year-old law that was a product of India’s colonial past.

BE SMART, HEAD HIGH, FAME, CONFIDENCE
Neuropsychiatrist Dr Era Dutta says that attraction to people outside your marriage is quite normal in a relationship. “We are attracted to power, beauty, confidence, fame and personality, both before and after marriage,” she says.
Husband is Busy or Wife is Working
Relationships have become more fragile than before mainly because spouses don’t have time for each other
NO SMART PHONE
The rise of social media has also, ironically, contributed towards emotional disconnection between spouses, leading to cheating.
women are emotional fools [PRAISE HER] (respect the women)
But she believes women engage in emotional affairs more than sexual ones. The common reasons for women to stray are a loveless marriage, neglect in the relationship, validation, lack of sexual thrill in the marriage and attraction towards exes.
CUT HER FRIEND CIRCLE
Dr Dutta recommends keeping a confidante, someone to deter you from acting on your attraction. “Have an SOS person, a friend or a therapist, someone whom you can call while facing a dilemma,” she says.

adultery laws have been diluted since 26 september 2018 judgment by CJI Supreme Court of India i.e., DIPAK MISRA JUDGMENT ON ADULTERY IN 2018
Deletethis has been welcomed by disgruntled ladies and their paramours
BUT adultery laws since bein decriminalized are NOT good for the couples or spouse who wish to live with the other spouse.
Adultery Laws need revision
Each and every fake metoo allegation need to be cut through a series of counter cases and the exact wordings spoken by such metoo accuser need to be countered as if they are proved to be motivated for vendetta then this metoo may be broken with ease
ReplyDeleteand this MeToo in that case shall NOT be called as #MeToo Movement but instead it be called as #Fake MeToo because there may be many women or girls who may be genuine and wanted to share their MeToo stories so the weeding out of the false cases is necessary to make the remaining #MeToo as genuine and reliable.
Like once, we read about Ira Dwiwedi and Chetan Bhagat Controversy on #MeToo wherein the writer Chetan Bhagat had politely asked as to :-
"Why the #MeToo Accuser offered her a kisses through email after years (after) facing sexual harrassment by such sexual predator (which he actually was NOT as per the email proofs submitted by her on Social Media)"
Similarly, a LTR needs to be filed on a #FakeMeToo Complaint filed by girl.
Only then, the false cases may end. For knowing more about how to handle a fake me too or
